Privacy Notice

This notice explains how Prosperity Enterprises collects, uses, and protects personal information in line with the Protection of Personal Information Act, 2013 (POPIA). A separate manual prepared under the Promotion of Access to Information Act (PAIA) is available at /paia.

1. Who we are

Prosperity Enterprises is a South African trust and company administration provider based in Cape Town. We operate the Prosperity Enterprise Suite, a compliance platform that administers trusts and companies, produces statutory documents, and assists with AI-drafted documents under human review. Our systems and client data are hosted in South Africa in the af-south-1 (Cape Town) region.

2. What personal information we process

  • Names and identifying details of trustees, directors, members, and beneficiaries.
  • South African ID numbers, passport numbers, and dates of birth.
  • Contact details such as email addresses, telephone numbers, and postal addresses.
  • Entity, trust, and company records, including founding and registration documents.
  • Beneficial-ownership information and related-party relationships.
  • Financial-compliance data needed for statutory filings, including tax reference numbers and supporting records.

3. Why we process it

  • To administer trusts and companies on behalf of our clients.
  • To meet statutory compliance obligations with the Companies and Intellectual Property Commission (CIPC), the South African Revenue Service (SARS), and the Financial Intelligence Centre Act (FICA).
  • To prepare, review, and file statutory documents and returns.
  • To maintain accurate beneficial-ownership and entity records.
  • To meet our own obligations as a responsible party under POPIA.

4. Lawful basis

We process personal information where it is necessary to perform a contract with you, to comply with a legal obligation imposed on us or on the entities we administer, to protect a legitimate interest, or with your consent. Where consent is the basis, you may withdraw it at any time, subject to the records we are required by law to retain.

5. How we protect your information

  • Personal information is encrypted in transit using current transport security.
  • Access is restricted through role-based access controls and authentication.
  • Material actions are recorded in an append-only audit log so that changes can be traced and verified.
  • Client data is hosted in South Africa in the af-south-1 (Cape Town) region.

6. Your rights under POPIA

As a data subject you have the right to:

  • Access the personal information we hold about you.
  • Request correction of information that is inaccurate or out of date.
  • Request deletion or erasure of information we are no longer entitled or required to keep.
  • Object to processing on reasonable grounds.
  • Lodge a complaint with the Information Regulator of South Africa.

7. Information Officer

To exercise any of your rights, or for any privacy query, contact our Information Officer at privacy@prosperityenterprises.site. We will respond within a reasonable time and in accordance with POPIA.

8. Retention

We keep personal information only for as long as it is needed for the purposes described above, or for as long as the law requires us to keep it. Statutory and compliance records are retained for the periods set by CIPC, SARS, and FICA. When information is no longer needed, it is securely deleted or anonymised.
